1. Acceptance of Terms
By accessing or using Graduin ("we", "us", "the Platform"), you agree to be bound by these Terms of Service. The Platform provides university application assistance and student accommodation listing services in South Africa. If you do not agree to these terms, do not use the Platform.
2. Description of Services
Graduin allows candidates to apply to multiple South African institutions through a single application process, and allows property owners or managers to list student accommodation. We facilitate information, application submission, and listing visibility. We do not guarantee admission to any institution or occupancy of any listed property; those outcomes are determined by the relevant institution or property owner.
3. User Accounts and Conduct
You must provide accurate information when creating an account. You are responsible for keeping your credentials secure and for all activity under your account. You may not use the Platform for any unlawful purpose, to misrepresent yourself, to harass others, or to violate any applicable laws or third-party rights. We may suspend or terminate accounts that breach these terms.
4. Applications and Listings
Application fees and related charges are set by institutions and/or Graduin and are payable as indicated during the application process. Property listing subscriptions are billed according to the tier you select. You are responsible for the accuracy of information you submit in applications or listings. Listing approval is subject to our internal review process.
5. Fees, Payments and Refunds
Application fees and subscription fees are non-refundable except as stated in our Refunds Policy. By completing a payment, you agree to the applicable fee and our refund rules. Subscription cancellations are handled as described in the Refunds Policy and in your subscription dashboard.
6. Intellectual Property
The Platform, including its design, text, graphics, and software, is owned by Graduin or its licensors. You may not copy, modify, or distribute our content without permission. User-generated content you submit remains yours, but you grant us a licence to use it to operate and promote the Platform.
7. Limitation of Liability
To the fullest extent permitted by law, Graduin and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability for any claim related to the Platform shall not exceed the amount you paid us in the twelve months preceding the claim. We do not guarantee uninterrupted or error-free service.
8. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any dispute shall be subject to the exclusive jurisdiction of the South African courts.
9. Changes
We may update these Terms of Service from time to time. We will post the updated terms on this page and update the "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the revised terms.
